Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

We do not respond to web browser Do Not Track signals at this time.

CPRA. The California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (“CPRA”) provides California residents with specific rights regarding their PII. The below describes such rights and how You (if You are a California resident) may exercise such rights, and Our information practices, including the categories of PII We collect, use, retain, disclose, sell or share, and how and why we collect, disclose, sell or share such information.

Right to Know
You have the right to request that We disclose what PII We collect, use, disclose, sell or share. Specifically, You may request that We disclose to You the following:

1. The categories of PII We have collected about You.
2. The categories of sources from which the PII is collected.
3. The business or commercial purpose for collecting, selling or sharing PII.
4. The categories of third parties with whom We disclose PII.
5. The specific pieces of PII We have collected about You.

You may also request that We disclose to you:

1. The categories of PII that We have sold or shared about You and the categories of third parties to whom the PII was sold or shared, by category or categories of PII for each third party to whom the PII was sold or shared.

Right to Request Deletion
You have the right to request that We delete any PII about You which We have collected from You. If it is necessary for Us to maintain Your PII for certain purposes, We are not required to comply with Your deletion request. If We determine that We will not delete your PII when You request Us to do so, We will inform You and tell You why We are not deleting it.

Right to Opt-Out of Sale or Sharing of PII
You have the right to direct a business that “sells” or “shares” (as such terms are defined in the CPRA) PII about You to third parties not to sell or share Your PII. The collection of data through certain cookies for our targeting advertising purposes may be considered a “sale” and is considered “sharing” under the CPRA. To opt-out of the sale or sharing of PII by VibeVeb on Our websites, please click the “Do Not Sell or Share My Personal Information” link located at the footer of Our websites. To opt-out of the sale or sharing of PII by VibeVeb on Our mobile applications, please go to Settings > Privacy Settings and toggle the button that states “Do Not Sell or Share My Personal Information”.

Right to Correct Inaccurate PII
You have the right to request a business that maintains inaccurate PII about You to correct that inaccurate PII, taking into account the nature of the PII and the purposes of the processing of the PII.

Right to Limit Use and Disclosure of Sensitive PII
You have the right to direct a business that collects sensitive PII about You to limit its use of Your sensitive PII (1) to that use which is necessary to perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services; (2) for certain business purposes; and (3) as authorized by the implementing regulations of the CPRA. As mentioned below, we collect, use and disclose your precise geolocation, which is considered sensitive PII under the CPRA, on Our mobile applications with your consent. To limit VibeVeb’s use of your sensitive PII on Our mobile applications, please go to Settings > Privacy Settings and toggle the button that states “Limit the Use of My Sensitive Personal Information” web page.

No Discrimination
You have the right not to be discriminated against because You exercised any of Your aforementioned rights.

How to Submit a Request
To exercise the rights described above, you must submit a verifiable request to us by sending us an email to slawis007@gmail.com

If You maintain an online account with Us, We will verify Your identity for a request through the normal account authentication process, meaning You will need to sign on with Your username and password.

If You do not maintain an online account with Us, You will be asked to provide certain information to help Us verify your identity. The information We ask You to provide to initiate a request may differ depending upon the type of request, the type, sensitivity, and value of the PII that is the subject of the request, and the risk of harm to You that may occur as a result of unauthorized access or deletion, among other factors.

You may designate an authorized agent to request on Your behalf by providing the agent with signed written permission to do so.

If We cannot verify Your identity or authority to make the request, We will not be able to comply with Your request. We will inform You if We cannot verify Your identity or authority. We will only use PII provided in a verifiable request to verify the requestor’s identity or authority to make the request.

EU/UK/SWITZERLAND RESIDENTS

Regulation (EU) 2016/679 (“GDPR”), any national law of an EU member state adopted pursuant to the GDPR, the U.K. Data Protection Act of 2018, and the Switzerland Federal Act on Data Protection (collectively, “Data Protection Laws”) provide EU, U.K. and Swiss residents with specific rights regarding their PII. The below describes such rights and how You (if You are an EU, U.K. or Swiss resident) may exercise such rights, and Our information practices, including Our legal bases for processing Your PII.

The categories of PII We process about You is set forth in the section entitled “What Information Do We Collect?”. The purposes for processing such PII are set forth in the section entitled “How Do We Use This Information?”.

Our legal bases for processing PII are as follows:

• Performance of Contract. We may use Your information to perform Our contractual services or prior to entering into an agreement with You. If You use the VibeVeb Sites or if You contact Us to request services, We use Your information to provide to You the features and functionality of the VibeVeb Sites and Our services, including for customer service.
• Legitimate Interest. We may use information for our legitimate interests, except where such interests are overridden by Your interests or fundamental rights and freedoms. For instance, We may use Your PII to contact You and respond to your requests and inquiries, to administer our business, to identify prevent and detect fraud or to pursue or defend Ourselves against legal claims.
• Consent. We may use Your information with Your consent. In these instances, We will ask You to grant Us consent to use Your information. You are free to grant or deny permission. If You deny permission, We will not be able to process Your information to conduct the activity to which the consent relates. For example, We will not be able to send you marketing materials that You request. You are also free to withdraw your consent at any time. A withdrawal of consent will not affect processing that has been completed during the time in which the consent was valid. If You have granted Us consent to use Your information, We will use it only for the purposes specified when We request Your consent. This includes use for Our marketing campaigns. We disclose the PII we process about You with the third parties set forth in the section entitled “How Do We Share This Information”.

As mentioned in the section entitled “How Long is the Information Stored?”, We will retain Your PII for as long as necessary to fulfill the purpose for which it was collected, or as required by applicable laws or regulation. Copies of information that you have updated, modified, or deleted will remain in our systems if applicable law requires us to retain it.

As mentioned in the section entitled “Where is the Information Stored?”, We provide the VibeVeb Sites from servers located in the United States. If you are accessing the VibVeb Sites from the EU, U.K. or Switzerland, We will only transfer your PII to the United States through the use of appropriate safeguards.

You have the right to request that We confirm what PII we collect or hold about You, provide a copy of Your PII to You in a machine-readable format and to ask us to correct or update the PII. You also have the right to ask us to delete Your PII that we hold, in accordance with applicable law. However, the deletion of the PII may impact Your access, use and ability to use features on the VibeVeb's Sites. You have the right to restrict Our processing of Your PII under certain circumstances. Additionally, You have the right to object, on grounds relating to Your particular situation, at any time to Our processing of Your PII, which is based on public interest or Our legitimate interests, including the profiling of data. In this case, We will stop processing Your PII, except for where We have compelling legal grounds for the processing which override Your interests, rights and freedoms, or for the exercise or defense of possible legal claims. You further have a right to object to the processing of your personal data for direct marketing purposes.

Most Cases

VibeVeb does not sell any information and does not collect any information, excluding those necessary to conduct marketing statistics and process and forward your order to our partners.
